Today we’re talking about a major change in U.S. immigration law — the new $100 asylum fees. If you or someone you know has an asylum case pending, this video will walk you through who must pay, when to pay, and how to pay — whether your case is with USCIS or EOIR in Immigration Court.” What Changed? • “Under H.R. 1, also called the One Big Beautiful Bill Act, asylum applicants now face two new mandatory fees: 1. A $100 filing fee for every new asylum application, Form I-589. 2. A $100 Annual Asylum Fee, due every year the case remains pending. • These fees are non-waivable. That means no exemptions for income, detention, or hardship.” Who Must Pay? • “The annual asylum fee applies to: o All principal applicants with pending asylum cases, either before USCIS or EOIR. o Derivatives — your spouse or children included on the I-589 — do not pay separately. • USCIS rules: o If you filed your I-589 on or before October 1, 2024 and your case is still pending on September 30, 2025, you must pay the FY 2025 annual fee. o If your case was already pending for more than one year before that date, you won’t owe for past years — just going forward. o If you filed on or after October 1, 2024, you’ll pay $100 every year on the anniversary of your filing date. • EOIR rules: o The fee applies to any asylum case that has been pending more than one year after July 4, 2025. o EOIR has recently given exact procedures how to pay” How to Pay A) USCIS (Affirmative Asylum) 1. USCIS will send you a notice when the fee is due. 2. You’ll log in to your myUSCIS online account. 3. Pay $100 online using card or bank account. 4. Save the receipt and calendar the next year’s due date. B) EOIR (Defensive Asylum in Court) 1. Use the EOIR Payment Portal, called ePay. 2. Select “I-589 Asylum Fee,” enter your A-Number, pay, and download the receipt with a Tracking ID. 3. File proof of payment with your court record. Part 4: Practical Notes (4:005:00) • “There are no waivers — everyone must pay. • Fees will increase with inflation starting in FY 2026, rounded to the nearest $10. • Always keep proof of payment — for USCIS, your receipt; for EOIR, your receipt and tracking ID. • Non-payment may lead to your application being denied or treated as abandoned.”
