FEDERAL COURT BLOCKS PENALTIES OVER THE ANNUAL ASYLUM FEE

A federal court has intervened in the new Annual Asylum Fee system affecting certain asylum applications pending with USCIS.

The court did not simply erase the fee. Instead, it blocked the government from enforcing certain consequences for missing the payment deadline while the litigation continues, and USCIS reopened its payment portal.

• what the court actually stopped,

• whether the Annual Asylum Fee still exists,

• who should be monitoring USCIS notices,

• why the payment portal matters, and

• what asylum applicants should do now.

⚠️ Do not assume that the fee has been cancelled. The legal situation is narrower and may continue to change.

Today I have an important update for people who have asylum applications pending with USCIS and have received, or may receive, an Annual Asylum Fee notice.

A federal court has stepped into the dispute over the new Annual Asylum Fee system.

But there is a lot of confusion about what the court actually did.

So what exactly happened?

First, the court did NOT simply eliminate the Annual Asylum Fee.

Instead, the court temporarily blocked USCIS from enforcing certain consequences for failing to pay the fee by the deadline while the lawsuit continues.

After the court order, USCIS reopened its online payment system so that certain applicants who missed the original payment deadline could still pay the outstanding fee.

That distinction is extremely important.

The correct message is NOT:

• the asylum fee is gone,

• nobody has to pay,

• or applicants can ignore USCIS notices.

The safer understanding is that the fee obligation may still exist, but the government’s ability to impose certain consequences for late payment has been restricted while the litigation is pending.

So who needs to pay attention to this?

This issue primarily concerns certain asylum applications that remain pending with USCIS for the periods identified in the fee rules and USCIS guidance.

Applicants with long-pending affirmative asylum cases should carefully review any Annual Asylum Fee notice they receive.

If USCIS has sent you a notice, do not throw it away.

Do not assume social-media posts saying “the court cancelled the asylum fee” are accurate.

Instead, check:

• whether your I-589 is pending with USCIS,

• whether USCIS has issued you a fee notice,

• whether the payment portal is available for your case,

• and whether you have proof of any payment already made.

There is another important distinction.

An asylum application pending with USCIS is not procedurally identical to a defensive asylum application pending in Immigration Court.

Different agencies and different procedural rules may apply.

So always confirm which agency currently has jurisdiction over the I-589.

Important:

This litigation is still ongoing.

The rules can change again because of a new court order, an appeal, a new regulation, or updated USCIS guidance.

That means asylum applicants should continue monitoring USCIS notices and keep their address updated with USCIS.

My practical advice is simple:

Do not ignore the Annual Asylum Fee issue.

Do not assume the fee has disappeared.

And if you received a notice, keep a copy of the notice and proof of payment in your immigration file.
