Today I’m going to explain the current H-1B visa process for 2026, including recent updates, how the lottery works, key deadlines, and what both employers and applicants need to know. If you are planning to apply this year, this video is extremely important for you. What is H-1B? The H-1B is a temporary work visa for specialty occupations. That means the job must require at least a bachelor’s degree in a specific field — for example: • Software engineers • IT professionals • Engineers • Financial analysts • Healthcare professionals You cannot apply on your own. A U.S. employer must sponsor you. Annual Cap & Lottery Each year there is a cap: • 65,000 regular cap • 20,000 additional spots for people with a U.S. master’s degree or higher Because demand is much higher than supply, USCIS runs a lottery. The process starts with electronic registration, usually in March. Employers submit an online registration and pay the registration fee. If selected in the lottery, the employer can then file the full H-1B petition. Step-by-Step Process Step 1: Job offer from a U.S. employer Step 2: Employer files electronic registration Step 3: Lottery selection Step 4: Labor Condition Application (LCA) approval from Department of Labor Step 5: Filing Form I-129 with USCIS Step 6: USCIS decision — approval, denial, or Request for Evidence Step 7: Consular processing or change of status If approved under the cap, employment usually starts October 1. Premium processing is available for faster adjudication. Important Notes • The employer must pay at least the prevailing wage. • Not all employers are subject to the cap — universities and certain nonprofit research institutions are cap-exempt. • If you are already in the U.S., timing and status strategy are critical. • H-1B can later be used as a pathway toward a green card. The H-1B process is competitive and technical. Preparation is key. If you’re an employer or professional planning to apply this year, start early and get proper legal guidance.
