Today I want to talk about an important new travel and vetting proposal announced by the U.S. Department of Homeland Security, or DHS. If this proposal becomes law, millions of travelers who currently enter the U.S. without a visa could soon be required to hand over years of personal digital information just to visit the United States. Let’s break down what DHS is proposing, who it affects, and why it’s controversial. WHAT IS THE VISA WAIVER PROGRAM? Under the Visa Waiver Program, citizens of about 40 countries — including the UK, most of Europe, Japan, Australia, and others — can travel to the U.S. for up to 90 days without applying for a visa. Instead, they only need approval through an online system called ESTA, which currently requires basic biographical and travel information. That may soon change. WHAT DHS IS PROPOSING Under the new DHS proposal, Visa Waiver travelers would be required to submit far more personal data through ESTA, including: • Five years of social media history, including usernames and platforms • Years of email addresses and phone numbers • Detailed personal background information • In some cases, biometric data like photos or facial recognition data This information would be reviewed before travelers are allowed to board a flight to the U.S. Importantly, this applies to people who previously did not need a visa at all. WHY THE GOVERNMENT SAYS THIS IS NECESSARY According to DHS, the goal is to strengthen national security by identifying potential risks before travelers reach U.S. borders. Officials argue that expanded digital screening helps detect threats earlier and improves overall border security. CRITICISM AND CONCERNS This proposal has raised serious concerns among privacy advocates, civil rights groups, and the travel industry. Privacy & Free Speech Critics warn that forcing travelers to disclose social media history could: • Violate privacy • Lead people to self-censor political opinions • Penalize lawful speech posted years ago There is concern that online expression could be misinterpreted or taken out of context. Impact on Travel Travel experts warn this could: • Discourage tourism and business travel • Make visiting the U.S. more complicated than visiting other countries • Hurt the U.S. economy, especially ahead of major international events IS THIS POLICY IN EFFECT? Not yet. The proposal has been published for public comment, meaning: • It is not final • The public can submit feedback • DHS can revise, delay, or withdraw it However, it signals a clear shift toward much stricter digital vetting. WHAT THIS MEANS GOING FORWARD If finalized, this rule would: • Expand U.S. surveillance of foreign travelers • Blur the line between visa-free travel and full visa screening • Set a precedent for digital background checks as a condition of entry In short, the U.S. government is considering a major change: People who once entered the U.S. with minimal paperwork may soon be required to share years of online and personal data just to visit. Whether this proposal becomes law — and how courts may respond — remains to be seen.
