1. Introduction
These Terms & Conditions (“Terms”) govern your use of any online services provided by Ogmen Law PLLC, including but not limited to:
- Our websites, such as ogmenlaw.com, ogmen.com, and related or staging domains such as cibily.com,
- Any current or future client-facing portals, web applications, desktop applications, or mobile applications operated by Ogmen Law PLLC (collectively, the “Services”).
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.
These Terms do not replace or modify any separate engagement letter, retainer agreement, or fee agreement between you and Ogmen Law PLLC. In the event of a conflict, your signed engagement or retainer agreement will control with respect to the attorney–client relationship.
This Terms & Conditions document applies to all digital systems, websites, and applications owned or operated by Ogmen Law PLLC, including ogmenlaw.com, ogmen.com, and cibily.com.
2. Eligibility and Lawful Use
2.1 Age Restriction
You must be at least 18 years old to use the Services. By using the Services, you confirm that you are at least 18 years old and have the authority to accept these Terms.
2.2 Lawful Use
You agree to use the Services in compliance with all applicable laws and in a manner that does not infringe the rights of others. You must not:
- Post or transmit false, misleading, or harmful information,
- Impersonate any person or entity,
- Disrupt or interfere with the proper functioning, security, or integrity of the Services.
3. Nature of Information and Services
3.1 Informational Purposes Only
The information provided on the Services is for general informational purposes only. It is not legal advice. You should not act or refrain from acting based on any information obtained from the Services without consulting a qualified attorney about your particular situation.
3.2 No Attorney–Client Relationship Through the Site
Your use of the Services, including sending us information through a contact form or email, does not by itself create an attorney–client relationship. An attorney–client relationship is formed only when Ogmen Law PLLC agrees to represent you and this is confirmed through a signed engagement/retainer agreement or other written confirmation.
4. Intellectual Property Rights
All content, designs, logos, graphics, and other materials available through the Services are owned by or licensed to Ogmen Law PLLC and are protected by copyright, trademark, and other intellectual property laws. You may not use, copy, reproduce, modify, distribute, or republish any content without our prior written permission.
5. User Responsibilities
5.1 Accuracy of Information
You are responsible for ensuring that any information you provide through the Services is accurate, complete, and up to date. Ogmen Law PLLC is not responsible for any consequences arising from inaccurate or incomplete information provided by you.
5.2 Security of Your Account
If you access any part of the Services through a user account or login, you must keep your password and other security credentials confidential. You are responsible for all activities that occur under your credentials, and any such activities will be deemed to have been carried out by you.
6. Acceptable Use and Prohibited Activities
You agree that you will not:
- Access or attempt to access any part of the Services or underlying systems that you are not authorized to use,
- Bypass or attempt to bypass any security or access control measures,
- Use robots, spiders, scrapers, or any automated means to access the Services or extract data without our express written permission,
- Reverse engineer, decompile, or attempt to derive the source code or underlying logic of our applications or integrations,
- Use the Services in a way that would cause Ogmen Law PLLC to violate the terms of any third-party system, including USCIS online systems or the USCIS Torch API, including but not limited to their terms of use, rate limits, authentication rules, technical restrictions, and access control requirements,
- Use any client’s USCIS login credentials, or third-party login credentials, in automated scripts or bots in violation of third-party terms,
- Submit fraudulent or abusive content or engage in any activity that is unlawful, harmful, or offensive.
Security testing and penetration testing against our systems is strictly prohibited without our prior written consent. This prohibition applies even to internal staff, unless they are explicitly and formally authorized in writing.
Access by team members located outside the United States is limited to strictly necessary support functions, is role-based, and does not override any access restrictions in these Terms. Unauthorized access from outside the United States is strictly prohibited.
7. SMS Terms & Conditions
7.1 SMS Notifications and Use
Ogmen Law PLLC may send individualized SMS notifications, updates, and reminders based on your explicit consent. These notifications may include case updates, appointment reminders, document requests, and important announcements related to your matter.
We do not conduct bulk marketing SMS campaigns. Message frequency may vary depending on your case, but we strive to keep SMS communications reasonable and relevant. Message and data rates may apply depending on your mobile carrier plan.
7.2 SMS Opt-In
You may subscribe (opt in) to SMS notifications by:
- Checking an opt-in box on our website or online forms, and/or
- Providing explicit consent during the case initiation process.

7.5 SMS Data Use and Sharing
SMS opt-in information and phone numbers collected specifically for SMS purposes are not shared with third parties for marketing or unrelated purposes. Phone numbers and SMS consent data are used solely for case-related communication and compliance (including TCR and RingCentral guidelines).
We do not sell your personal information or use it for cross-context behavioral advertising, and we do not permit our service providers to use SMS-related data for their own advertising or profiling purposes.
8. Electronic Communications and Electronic Signatures
By using the Services, you agree that we may communicate with you electronically (including via email, SMS, portal notifications, and similar means). Where permitted by law, electronic communications and electronic signatures provided through the Services may have the same legal effect as written, signed documents.

The Services may contain links to third-party websites or services. Ogmen Law PLLC is not responsible for the content, privacy practices, or security of these external sites. Your use of external links is at your own risk, and you are encouraged to review their terms and privacy policies.
10. Disclaimers
The Services are provided on an “AS IS” and “AS AVAILABLE” basis. To the maximum extent permitted by law, Ogmen Law PLLC disclaims all warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not guarantee that the Services will be uninterrupted, secure, or error-free, or that any defects will be corrected. We do not guarantee that any information obtained from the Services will be current, complete, or accurate for your specific situation.
11. Limitation of Liability
To the fullest extent permitted by applicable law:
- In no event shall Ogmen Law PLLC, its attorneys, employees, and agents be liable for any indirect, special, incidental, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising out of or in connection with the use of (or inability to use) the Services or these Terms, even if we have been advised of the possibility of such damages.
- To the extent we are found liable for any direct damages, our total aggregate liability to you for all claims related to the Services or these Terms will not exceed one hundred U.S. dollars (USD $100), unless a different limit is expressly stated in a separate engagement or retainer agreement.
Some jurisdictions do not allow certain limitations of liability; in such cases, these limitations will apply only to the extent permitted by law.
12. Indemnification
You agree to indemnify, defend, and hold harmless Ogmen Law PLLC and its attorneys, employees, and agents from and against any and all claims, liabilities, damages, losses, and costs (including reasonable attorneys’ fees) arising out of or related to:
- Your use or misuse of the Services,
- Your violation of these Terms or any applicable law,
- Your infringement of any third party’s rights, including privacy and intellectual property rights.
13. Mandatory Arbitration and Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
13.1 Agreement to Arbitrate
You and Ogmen Law PLLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Services (collectively, “Disputes”) will be resolved exclusively by binding arbitration, rather than by a court, except as described below. Arbitration is the exclusive method of dispute resolution for Disputes between you and Ogmen Law PLLC, except as provided in Section 13.5. To the fullest extent permitted by law, you and Ogmen Law PLLC each waive any right to a jury trial in any Dispute.
13.2 Rules and Forum
Arbitration will be administered by the American Arbitration Association (“AAA”) under its applicable rules (including the Consumer Arbitration Rules, if applicable), as modified by these Terms. Arbitration will take place in New York, New York, or Hackensack, New Jersey (or another mutually agreed location), in English.
13.3 Federal Arbitration Act
The Federal Arbitration Act (FAA) governs the interpretation and enforcement of this arbitration agreement.
13.4 Individual Basis Only – No Class Actions
You and Ogmen Law PLLC agree that each may bring claims only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate claims of multiple persons or preside over any form of class or representative proceeding.
13.5 Exceptions
You or Ogmen Law PLLC may bring an individual action in a small claims court of competent jurisdiction. You or Ogmen Law PLLC may also seek injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual property or confidentiality rights.
14. Governing Law and Jurisdiction
These Terms and any Disputes are governed by the laws of the State of New York and, where applicable, the laws of the State of New Jersey, without regard to conflict-of-laws principles that would result in the application of the laws of any other jurisdiction.
Subject to the arbitration provisions above, for any Dispute that is not subject to arbitration (or where arbitration is not enforced), you agree that the state and federal courts located in New York County, New York, or Bergen County, New Jersey will have exclusive jurisdiction.
15. Changes to These Terms
Ogmen Law PLLC may update these Terms from time to time. Changes will become effective when posted on the Services or otherwise communicated to you.
Where required, we will seek your explicit consent to material changes (for example, by presenting updated Terms and requiring you to click “I agree” before accessing certain portals or applications). Your continued use of the Services after changes become effective constitutes your acceptance of the updated Terms.
16. Miscellaneous
- If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
- Our failure to enforce any right or provision of these Terms does not constitute a waiver of such right or provision.
- These Terms do not create any third-party beneficiary rights.
