“Major immigration news! USCIS has announced a proposal that would dramatically expand the agency’s authority to collect biometric data from immigrants, sponsors, and even U.S. citizens connected to immigration filings. This includes fingerprints, palm prints, iris scans, voice prints, and even DNA. Today, I’ll explain exactly what USCIS is proposing, why they say they need this, and how it may affect you or your clients.” 1. What Did USCIS Announce? “In November 2025, the Department of Homeland Security released a major proposed rule titled: ‘Collection and Use of Biometrics by USCIS.’ This rule would give USCIS the authority to collect far more types of biometric data, including: • Fingerprints • Palm prints • Facial photographs • Iris and retina scans • Voice prints • Signature samples • Body movement and posture imaging • AND, in some cases, DNA or DNA-derived data This would replace the current limited system with a much broader biometric program.” 2. Who Will Be Required to Provide Biometrics? “This is one of the biggest changes. Under this proposal, biometrics could be required not only from: • Applicants • Petitioners • Beneficiaries • Derivative family members But also from ANY person ‘associated with’ an immigration benefit request. That includes: • Sponsors • Household members • Interpreters • Affidavit of Support sponsors • Even U.S. citizens if connected to the application There would also be no age limits — meaning children and elderly applicants could be required to give biometrics.” 3. Why Is USCIS Doing This? “DHS says the goal is to: • Increase identity verification • Reduce fraud • Strengthen national security • Enable continuous vetting throughout the immigration process • Modernize the outdated fingerprint-only system They also estimate the number of annual biometric collections will jump from 2 million to over 3.1 million per year.” 4. What Are the Biggest Concerns? “There are serious privacy and civil liberty concerns, including: • DNA collection raises questions about genetic databases • Iris/retina scans are extremely sensitive biometric identifiers • Continuous vetting may allow tracking throughout a person’s entire immigration journey • Data sharing with other federal agencies could expand • Children’s biometrics would be stored long-term • The rule may give USCIS too much discretion over who must provide biometrics Advocacy groups warn that this could create the largest biometric database in U.S. history.” 5. Does This Rule Take Effect Immediately? “No. This is a proposed rule, not a final one. The public comment period remains open until January 2, 2026. After that, DHS will decide whether to finalize, modify, or withdraw the rule.” 6. What Should Applicants Do Now? “Here’s what you should be prepared for: • Expect more biometric appointment notices • Plan for possible additional costs • Understand that more types of personal data may be collected • Sponsors and household members should also expect biometric checks • Monitor DHS and USCIS announcements closely If this rule becomes final, the immigration process will change significantly.”
