Instead of selecting H1B applicants through a random lottery, they want to prioritize applicants with higher salaries—aka a wage-based system. HOW IT WOULD WORK Under this system, USCIS would rank applicants by wage level—from Level I (entry-level) to Level IV (expert-level)—and those at the top salary tiers get picked first. This means the higher the pay, the better your chance of getting selected. LEGAL HISTORY Sound familiar? That’s because a similar rule was introduced under the Trump administration, but it got blocked in court for skipping key procedures. Now, the Trump administration is trying again—this time following the full rulemaking process. WHAT’S NEXT? The rule is now under White House OIRA review, which usually takes 30–90 days. After that, we might see a Notice of Proposed Rulemaking and a public comment period. It likely won’t impact FY 2026 but could go live for FY 2027. WHO’S AFFECTED? High-wage tech roles and senior professionals will benefit. Entry-level and outsourcing-heavy jobs may see lower selection chances. Employers may need to raise salaries to stay competitive in the H1B game.
